What Happens If You Ignore a Court Summons in Zambia?

Receiving a court summons can be frightening or confusing. Some people believe that avoiding a process server, refusing to accept court documents or failing to attend court will make the matter disappear.

It will not.

A court summons is a formal legal document connected to court proceedings. It may require you to appear in court, respond to a claim, answer criminal proceedings, attend as a witness or produce documents.

Ignoring a court summons may not stop the case. The legal process may continue without you.

What Can Happen If You Ignore a Court Summons?

  1. The Court May Proceed Without You

In a civil matter, failing to respond after proper service may allow the claimant to take further legal steps.

In appropriate cases, judgment in default may be entered against you.

The court cannot consider a defence that has not been properly placed before it.

If judgment is entered against you, the successful party may take lawful steps to enforce it.

By the time enforcement begins, the matter may be more complicated and expensive to address.
